Abstract: In the preliminary chamber procedure, considered by some authors a phase of the criminal process, an opinion we agree with, and by other authors a stage of the trial phase, the legality of the activity carried out in the criminal investigation phase by the preliminary chamber judge is verified, the legislator offering and a series of specific attributions of nature to fulfill the purpose of this stage.
