Chapter Chapter 10 in Contracting in the New Economy, 2021, pp 137-147 from Springer
Abstract:
Abstract In this chapter, A Systemization of Contracts, another common question is addressed: “What contract types should be relational contracts?” This is a great question when one considers there is a myriad of different contract types—ranging from a simple purchase order of goods based on standard terms to complex contracts such as business process outsourcing or construction contracts. There are franchise contracts and shareholders agreements. Simply put, there are dozens, if not hundreds, of contract types. This chapter provides a systemization of contracts to help answer the question of what types of contracts should be relational contracts. In this chapter, a framework is shared which uses two dimensions—an input/output dimension and a capital resource dimension. These two dimensions reflect a view of a business organization as a contract-based enterprise system.
