Abstract: The aim of this paper is to study the (non-drastic) patent dynamics when their users have private information with respect to the patent owner and the rival users. We found that, together with the sampling effect and the dissipation effect, an informational effect appears and, as a consequence, the market efficient allocations are modified with respect to the symmetric information setting. In particular, the monopolistic structures are more likely than in the symmetric information framework and the duopolistic ones are less frequent. Nevertheless, the incentive-compatibility conditions are always satisfied and all efficient allocations are also optimal to the patent owner. It is shown that the social first best is duopoly-duopoly. Finally, we found some conditions that lead to a positive relationship between the patent length and the social expected welfare.
