Abstract:
The author cites numerous examples from the practice of application of Art. 1851 of the Criminal Code of RM, Art. 96 of the Contravention Code of RM, emphasizing that legal reality refutes the absolute (strict) territoriality of intellectual rights. Private law relations arising from IARs and means of individualization based on the law of one state are often closely related to foreign law. Multinational intellectual rights are functionally interrelated. This testifies against “strict territoriality” and in favor of “relative territoriality” of national/regional subjective exclusive rights.
