Abstract:
Posted workers are not a fundamentally new phenomenon in the employment market. Historically, migrant workers are well known. In the European Union, however, migrant workers obtained its own state, represented by the term „posted worker“. Due to the ,posted workers directive’ and its national implementation, transnational dependent work should be regulated in a way, that excessive imbalances of different working conditions are avoided. In our exploratory study, we are tracing how the regulations show up in industry-specific practice and how the living and working conditions of „posted workers“ are shaped. It becomes apparent that this form of transnational mobile work is a persistent phenomenon in the European labour market, but the players themselves are not that visible and implementation differences between European and national regulatory efforts open abuse niches.l
