Teachers’ professional digital competence: ensuring legal compliance and protection

Abstract:
This chapter argues that professional digital competence must include legal knowledge. It considers how this expanded digital legal competence should incorporate knowledge of legislation related to intellectual property, privacy, data protection, copyright, digital ethics and jurisdictional issues in educational contexts. The chapter also emphasizes educators’ duty of care regarding the technologies they use. Legal complications can arise when educators use tools that may not comply with local legislation or compromise intellectual property. Future teachers must understand their legal responsibilities when using technology in schools. Their digital competencies should cover the legal implications of using copyrighted material, protecting intellectual property rights, and ensuring that chosen platforms are fit for purpose. Educators must ensure that student data is shared in secure online spaces without compromising cybersecurity or creating jurisdictional problems. The chapter also addresses the evolving nature of legal digital competence in the classroom, where teachers must also protect students’ rights.
