Abstract: The world in which we live is surrounded by a multitude of legal relationships of work. As with any civil legal relationship and labor conventions, it is necessary to have the parties' alter native character and to execute in good faith the rights and obligations assumed, each participant pursuing the legal effects and assuming possible legal liability. Whenever these elements are flawed, we are more or less in the presence of a labor conflict. In these situations, which have different causes, it is desired to restore the violated rights of the employer or, most frequently, the rights of the employee. Labor law is a branch of the Romanian unitary law, in the area of private law, in which the parties are dealt with in legal equality positions. It follows from this that whenever we find ourselves in the presence of any contradictory situation in the non-observance of the regulations regarding this matter, the provisions of the special laws will be applied for the commencement of legal actions, the latter being completed with the provisions of law common in the Code of Civil Procedure.
